Our total liability for any claims arising from or related to your use of the website shall not exceed the amount you paid to us, if any, for accessing the website, or one hundred dollars ($100), whichever is greater.

The limitations of liability set forth in this section shall apply regardless of the theory of liability, whether based on contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms of Use, or the breach, termination, or invalidity thereof, shall be settled through good faith negotiations between the parties.

If the parties are unable to resolve the dispute through negotiations within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Indianapolis, Indiana, and shall be conducted in the English language.

Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the federal or state courts located in Indianapolis, Indiana, and you hereby consent to the personal jurisdiction and venue of such courts.

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect.
